This is a general starting template, not a substitute for review by a lawyer. The liability, waiver, and indemnification language below is especially worth having an attorney licensed in your state review before you rely on it — enforceability of injury/liability waivers varies significantly by state, and some limitations (like waiving liability for gross negligence or willful misconduct) are not enforceable no matter how they're worded.

What Future Tech is

Future Tech is a platform that connects businesses and individuals who need drone services with independent drone pilots. We are not a party to the work performed between a client and a pilot — we provide the directory, job board, messaging, and payment processing that let both sides find each other and transact.

Independent contractor relationship

Pilots who accept jobs through Future Tech are independent contractors engaged directly by the client, not employees, agents, or representatives of Future Tech. Future Tech does not direct, supervise, or control how a pilot performs any job, and is not a party to the agreement formed between a client and a pilot when a job is accepted. Clients are solely responsible for confirming a pilot is qualified, licensed, and insured for the work being requested.

Pilot certification

Pilots self-attest to holding a valid FAA Part 107 remote pilot certificate when completing their profile. Future Tech does not independently verify certification numbers or license status with the FAA or any other authority, and makes no representation or warranty as to the accuracy of any pilot's self-reported credentials, experience, insurance, or equipment. Clients are responsible for confirming a pilot's credentials and insurance to their own satisfaction before engaging them for work.

Assumption of risk

Operating and being present around unmanned aircraft (drones) carries inherent risks, including but not limited to property damage, personal injury, death, equipment malfunction or loss of control, privacy or airspace violations, and regulatory enforcement action. By using Future Tech to arrange or perform drone work, you voluntarily accept and assume all such risks, whether known or unknown, arising from or connected to any job arranged through the platform.

Release and waiver of liability

To the fullest extent permitted by law, you release, waive, and discharge Future Tech, its owners, officers, employees, and contractors from any and all liability, claims, demands, or causes of action arising out of or related to any job arranged through the platform — including claims for personal injury, death, property damage, or loss of any kind — whether caused by the negligence of a client, a pilot, or any other third party. This release does not apply to Future Tech's own gross negligence or willful misconduct in operating the platform itself, and nothing here waives any right or protection that cannot lawfully be waived in your jurisdiction.

Indemnification

You agree to indemnify and hold harmless Future Tech, its owners, officers, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of the platform, (b) any job you post, accept, or perform through the platform, (c) your violation of these terms, or (d) your violation of any law or the rights of a third party, including any injury, death, or property damage arising from drone operations you performed or requested.

Insurance

Future Tech does not provide, arrange, or guarantee liability insurance, hull insurance, or any other coverage for pilots or clients. Pilots are strongly encouraged to carry their own drone liability insurance (through providers such as SkyWatch.AI, BWI Fly, Avion Insurance, or a commercial general liability policy that covers UAS operations) before accepting any job, and clients are encouraged to confirm a pilot's coverage before hiring them. Future Tech accepts no responsibility for a pilot's or client's failure to maintain adequate insurance.

Payments

Payments are processed by Stripe. When a client accepts a pilot for a job, the client is charged through Stripe Checkout; funds are held by the platform until the pilot marks the job complete, at which point payout is released to the pilot's connected Stripe account, minus the platform fee. Future Tech does not store card numbers or bank account details — that data is handled directly by Stripe.

Prohibited conduct

You may not use Future Tech to post fraudulent job listings, misrepresent your certification or business identity, circumvent the platform's payment system for a booking made through it, harass other users, or use the service for any unlawful purpose.

Disclaimer of warranties

Future Tech is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the quality, safety, legality, timeliness, or outcome of any drone work arranged through the platform, or that pilots listed on the platform are in fact certified, insured, or competent.

Limitation of liability

To the fullest extent permitted by law, Future Tech and its owners, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the platform or any job arranged through it. Future Tech's total aggregate liability for any claim arising out of or relating to the platform will not exceed the greater of (a) the total platform fees you paid to Future Tech in the twelve months before the claim arose, or (b) one hundred dollars ($100). Use of the platform, and any agreement to hire or perform drone services arranged through it, is at your own risk.

Dispute resolution & governing law

These terms are governed by the laws of the State of Michigan, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the platform will first be attempted to be resolved informally by contacting us. If informal resolution fails, you and Future Tech agree that any remaining dispute will be resolved through binding arbitration on an individual basis, and not as a class, collective, or representative action, except where such an arbitration agreement or class-action waiver is not enforceable under applicable law.

Severability

If any provision of these terms is found unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
